In the meeting of the DUTA executive held on 12.10.13, the following resolution was unanimously passed:
1. While welcoming the suspension of the Principal of BR Ambedkar College, the DUTA is of the opinion that it is a case of too little too late. Suspension is not a punishment, but a mere a pre-requisite for the institution of a fair enquiry into the charges against him, since he is in a position to influence the investigations as long as he occupies the office of Principal. The DUTA urges the Governing Body to initiate disciplinary proceedings against the Principal under Ordinance XVIII, and to set up an independent enquiry into the charges leveled by Pavitra Bhardwaj against the Principal. These would include sexual harassment and mental torture, maladministration and violation of Ordinance XV(D). The enquiry should be conducted by a retired judge of a level not less than the High Court, and proper terms of reference should be framed. The DUTA would like to point out that any decision simply to co-operate with an enquiry set up by the Delhi Government would not be in consonance with the requirement of Ordinance XVIII since the employee is not an employee of Delhi Government but of Ambedkar College, that is a constituent college of Delhi University, which is a Central University.
2. It is shameful that the police has not yet registered an FIR against the Principal whom Pavitra has held responsible for her death in several suicide notes and in her dying declaration given before the SDM. The DUTA resolves to intensify the agitation against the Police Commissioner to ensure that GK Arora is arrested under section 306.
