VICTORY FOR TEACHERS IN PENSION CASE!
The DUTA welcomes the judgment of the Hon’ble Double Bench of Justice Ravinder Bhatt in a case concerning grant of pension(GPF) to University and College employees who had been incorrectly placed in the CPF(lump sum) scheme by their administration despite the then Government Policy of placing all incumbent employees in GPF.
This has come as a great relief to teachers of all categories, especially those who had retired and were facing tremendous financial hardship with no pension. In April 2014, the learned Bench of Justice Shakdher had given relief to two categories of petitioners, which was stayed in September that year as a result of an appeal filed before the Hon’ble Double Bench by Delhi University under the direction of the Vice Chancellor Prof Dinesh Singh. Subsequently, claiming that all categories of pension were “subjudice”, the University administration had held up pension even in the case of those employees who were not covered by the court cases, namely those placed in GPF by the University itself.
Withdrawal of the vindictive appeal and grant of relief to all categories has been one of the major demands of the DUTA.
Today’s judgment has dismissed the appeal of the University. It has also upheld the appeal of the section of teachers who had not been granted relief by the Single Bench. Thus it has upheld grant of pension to all categories of teachers, and the stand of the DUTA stands vindicated.
DUTA congratulates all teachers for the arduous struggle to secure their rights. It appeals to University authorities to ensure speedy implementation of pension especially to retired colleagues who have been unfairly put to great hardship in the evening of their lives by a callous and vindictive erstwhile administration.
