Subject: Regarding the UGC Public Notice dated7.12.2018 on the grant of non-compounded advance increments and benefit of
number of years required for promotion under CAS for candidates who have
registered/enrolled/completed Ph. D.  degrees before 11 July 2009.
Dear Professor Singh,
We write to draw your attention to the PublicNotice issued by the UGC on 7 December 2018 (F.No.28-9/2018/(PS/Misc)). The
notice lays down five requirements for Ph.D. which shall be considered for the
grant of non-compounded advance increments and benefits of the number of years
required for promotion under CAS for candidates who have
registered/enrolled/completed Ph. D.  degrees before 11 July 2009. 
It is pertinent to mention that this public notice
requires teachers to fulfill these conditions retrospectively which is patently
illegal. It is important to recognise that Universities have granted Ph.Ds as
per Ordinances amended from time to time by their respective statutory bodies
and as per UGC Regulations. Hence it is illogical to impose a Regulation which
is retrospective in its application and can cause tremendous hardship to
teachers, both financial and in terms of career progression. Moreover this goes
against the very Act of UGC which clearly states that no Regulation can be
applied retrospectively on teachers if it is prejudicial to their
interests. 
DUTA strongly feels that this public notice is
completely uncalled for since it may become a basis to withdraw benefits to
teachers which have been accrued to them over the last many years as per the
admissible CAS or which have been promised to many others awaiting their
promotion for years.
We request you to withdraw this Public Notice
urgently since it will lead to chaos and confusion amongst teachers along with
unmitigated financial hardships and unnecessary litigations.
