Appeal to Staff Associations to discuss EWS Expansion and Reservation and send feedback by 20 June 2019

Dear Colleagues,
The DUTA Executive met on 8.06.2019 to discuss various issues which confront us today. Inaction by the Vice Chancellor has caused paralysis in the university as major issues of teachers have remained unresolved. Meetings of the Executive Council have not been convened despite repeated appeals by the DUTA to resolve issues regarding promotions, counting of past services, recovery, adoption of the UGC Regulations 2018, dropping of the clause of contractual appointments, resolution of the retirement age of Physical Education teachers, formation of Governing Bodies, guidelines for Guest Faculty and EWS Reservation.
The DUTA Executive discussed the following issues.
1. EWS Expansion: Delhi University and its colleges are ill prepared to deal with this expansion as the OBC second tranche posts have not been released yet and additional hands as required by CBCS were never sanctioned to colleges. While the Government had sought requirements towards EWS expansion in January 2019, no grants for additional infrastructure and teaching and non-teaching posts has been sanction to colleges.
2. EWS Reservation in teaching posts The Government of India DoPT Office Memorandum No.36039/1/2019-Esst (Res) dated 31.01.2019 directs mandatory reservation for Economically Weaker Sections (EWSs) in direct recruitment in civil posts and services in the Government of India. The University notified implementation of EWS through an Office Memorandum dated 28.03.2019 (issued by Deputy Registrar, Recruitment) without discussing/amending EC resolution no. 64, 28.09.2013 and its adoption in the Executive Council.
Further, at present there are many teachers who have been working on ad hoc basis for several years in the University and its colleges because hardly any permanent appointments have taken place for one reason or the other. The implementation of EWSs Reservation will thus lead to large scale displacement of teachers currently working against Unreserved (UR) posts on as hoc basis.
3. Formation of Governing Bodies and crisis in Delhi Government partially or fully funded colleges because of the ongoing impasse: Employees are the worst hit in this stand-off as salaries, medical reimbursement etc. have been denied following stoppage of grants by the Delhi Government.
4. Adoption of the UGC Regulations 2018: It is extremely shocking to note that the UGC Regulations 2018 have still not been adopted by the University. The University has failed to adhere to deadlines set for its adoption. Teachers have been stagnating in colleges and University and adoption of the UGC Regulations 2018 is extremely important to resolve this. Counting of past service is yet important issue to be resolved for promotions to start in colleges/Departments. The Committee report is pending before the EC for its consideration.
The University’s insistence in adopting clause on “contractual appointment” is completely unacceptable. Similarly, dropping Physical Education from the list of subjects in the Ordinances even as it is mandated by the UGC Regulations 2018 is an attack on the services of teachers of Physical education. This is completely unacceptable.
The UGC has issued Guidelines for Guest Faculty under 7 CPC on 28.01.2019. The DUTA had written to the University to evolve its own guidelines regarding Guest appointment and service conditions through Executive Council without which there will be chaos. However, like on other matters, no action has been taken.
5. Retirement age of teachers of Physical Education: In the matter of Physical Education teachers, the indifference shown by the University in the face of arbitrary actions of the Principals of Vivekananda College and Shyamlal College (E) is completely shocking. Despite the long struggle launched by the DUTA, the University and the College Principals rode roughshod over existing rules and regulations applicable to these teachers who should retire at the same age as other teachers. Though Dr Meera Sood of Vivekananda College has got partial relief from the Court, our colleague from Shyam Lal College (E) continues to face similar crisis.
Following the DUTA Executive meeting of 8 June, the DUTA has written once again to the HRD, Minister, the Chief Minister of Delhi and the Vice Chancellor to demand relief.
The DUTA will organise a Protest Dharna on 17 June, 9:30 am to 1 pm at the residence of Chief Minister, Delhi Government to demand immediate release of salaries of employees in the fully maintained colleges. We appeal to Staff Associations to mobilise for the action programme. Please find the poster enclosed.
The DUTA Executive has decided to launch an aggressive struggle for the realisation of our demands. We appeal to Staff Associations to hold meetings to discuss these issues and send their feedback regarding action programmes, including admission boycott, by 20 June 2019.
