Sub:    EC Resolution to Release of Pensions to Retired Teachers

Dear Prof Tyagi,

The DUTA has been writing to you frequently with regard to the ongoing crisis over release of pensions to retired teachers and non-teaching employees.

We are writing this letter specifically to draw your attention to the grievances of those teachers and non-teaching employees whose CPF accounts were closed more than 18 years ago by the Colleges/University and who were given GPF account numbers thereafter.  Prior to 01/01/1986 there were only two schemes for retiring employees: (i) CPF and (ii) GPF-cum-Pension-cum-Gratuity. In the act of closing the CPF accounts of these teachers, the Colleges/University entered into a contract/agreement with these teachers that in lieu of their surrendered CPF they would be given pension when they retired.

When these teachers  retired,  they  retired  as pensioners  and it is extremely  unfair,  and, in fact,  illogical and illegal,  amounting   to breach of contract, and a violation of the Principle of Estoppel, to deny pension to these teachers  and non-teaching employees.

We request you to release pensions to these teachers and non-teaching   employees.  As a public institution,   it would be highly improper for the University to deny these teachers and non-teaching employees their legitimate   claim to pension.  Specifically, we request you to pass a resolution in the forthcoming meeting of the Executive Council to release pension to all those who have been given GPF account Numbers by the Colleges/University.

The DUTA requests you to take the above steps as an indication   of your positive attitude to this issue. We remain committed to ensuring that pension is made available to all our teachers as and when they retire.
