DUTA Letter to VC on Physical Education Teachers, 03.04.2017

Dear Prof Tyagi,

This is to bring to your notice certain steps taken by the University administration that are likely to hold up the process of making permanent appointments in various colleges of Delhi University.

Despite the clarification given in both the AC and the EC that there is no decision to revert Assistant and Associate Professors in Physical Education in colleges back to DPEs, a letter to this effect has been sent to various Colleges by AR(Colleges), thereby directing colleges to remove Physical Education from the teaching roster. As a result, there is much confusion in colleges such as Vivekanand, Institute of Home Economics, Laxmi Bai, which has led to holding up of the roster and advertisement for teaching posts. Wherever the colleges have included Physical Education, the University officials are objecting and sending the roster back to the colleges. This move by the University administration is not backed by any AC/EC resolution or changes in Ordinances, and is therefore illegal. Moreover, it is likely to set off a chain of fresh changes in the teaching roster by forcing colleges to remove the discipline of Physical Education from it.

As has been pointed out by the DUTA in several communications to you, the re-designation of DPE’s in Colleges to Lecturers in Physical Education had been effected by the EC more than thirty years ago and Ordinances framed accordingly. No reversal can be effected without amending all those Ordinances and passing specific EC Resolutions to that effect. In any case, no reversal can be retrospective as it would violate the Principles of Estoppel and of Natural Justice. It is shocking that the University administration is now sending directions to Colleges in violation of existing Ordinances and EC Resolutions. These direction are also in violation of Clause 4 and 5 of UGC Clarification dated 8.4.2016 issued in response to a pointed query dated 31.12.2015 by DR (South Campus).

The DUTA has deliberated this matter at length and will strongly oppose any roster without the inclusion of the Department of Physical Education in keeping with the University Ordinances and EC Resolutions.

We urge you to personally look into the matter and have a clarification issued to all colleges that there is no change in status of Physical Education teachers in colleges, and that the roster should be prepared accordingly, so that appointments can begin at the earliest.
